DUI Blood Tests
San Diego DUI Lawyer
If you are arrested for DUI you may be taken to the police station to take a blood test. On the basis of the results, you may be charged for DUI and face loss of your driver's license and possible jail time. Some assume blood tests are infallible. No. They are not. Technicians can blunder and nullify results.
At JD Law - Criminal Defense Specialists, clients have the benefit of a Board Certified Criminal Law Specialist, Attorney James Dicks. He is intimately familiar with blood test procedure and challenges technician goofs to vindicate clients. Since 1990 he has defended San Diego clients charged with DUI and has won recognition in the legal community for his skill. He is often asked to lecture fellow lawyers on defense techniques. If you are charged with DUI, you owe it to yourself to have strong DUI defense. You are urged to contact a
San Diego DUI attorney.
Blood Test Procedure
Blood tests in San Diego must be done by the book or their results are invalid. According to Title 17 of the California Code of Regulations, here are some of the requirements of blood test administration:
- A trained technician must administer the test.
- The draw site, that is the skin where the sample is taken, must be sterilized with a substance other than alcohol. Using alcohol could increase the alcohol in the test sample.
- There must be adequate preservatives and anticoagulants in the vial to prevent contamination and clotting of the sample.
- The sample must be properly stored.
- The chain of custody of the sample must be recorded and undisturbed.
Where these procedures are violated, our DUI defense attorney challenges blood test results. He seeks to have the results thrown out. Where that motion fails, he attacks the blood alcohol content (BAC) results as inaccurate and demands acquittal of charges.
