Preliminary Alcohol Screening Tests
San Diego DUI Defense Lawyer
A preliminary alcohol screening test is a sobriety test that an officer administers at the scene of an incident, such as an accident, a sobriety check point or when the officer pulls over the suspected driver. It is usually in the form of a
breath test kit or
breathalyzer. For individuals who are over the age of 21 and not on probation, refusal of the preliminary breath test is allowed, but an officer will still threaten to
suspend the driver's license until further tests are conducted.
The accuracy of the alcohol screening tests is quite inaccurate however. In almost one of every four cases, a BAC result will show that an individual's alcohol levels are higher than they actually are. Used to determine the blood alcohol concentration in a driver's blood indirectly through a fuel cell technology, the preliminary alcohol screening test will compute a number based on a standard formula to present the BAC percentage.
Aggressive Legal Representation & Defense for Preliminary Alcohol Tests
While it is obvious that not every individual's levels of molecules in their breath and in their body are the same, the preliminary alcohol screening test assumes that each individual is exactly the same. As such, a San Diego DUI attorney can challenge the results of a test for an individual who has been arrested on
DUI charges.
