Qualifications for a Restricted License
For first time DUI in San Diego, if you failed to ask for a DUI hearing or lost at the hearing, your license will be suspended for 120 days. After 30 days have elapsed of your suspension period, you may seek a restricted license. You need to show that you have enrolled in a DUI education program, provide an SR-22 showing proof of insurance and pay a re-issuance fee.
If you have refused the breath or other
chemical test or have a
prior DUI, you need to wait one year before applying for a restricted license. With a prior DUI, at that time you must show that you are enrolled in an SB 38 18 month education program and have completed a substantial part of it. You must also show an SR-22 and pay a reissuance fee.
